Welcome to FlatShare Portugal ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website located at www.theflatshare.com and our mobile application (collectively, the "Service") operated by FlatShare Portugal.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Definitions

• "Platform" means the FlatShare website and mobile applications
• "User" means any person who accesses or uses the Platform
• "Landlord" means any User offering accommodation through the Platform
• "Tenant" means any User seeking accommodation through the Platform
• "Listing" means an advertisement for accommodation posted on the Platform
• "Content" means any text, images, videos, or other materials posted on the Platform

3. User Registration and Accounts

3.1 Account Creation

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 Age Requirements

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you are at least 18 years of age.

5.1 Listing Accuracy

Landlords are responsible for ensuring that their listings are accurate, complete, and not misleading. All information provided must be truthful and up-to-date.

5.2 No Endorsement

We do not endorse any listings, users, or their content. We are not a party to any rental agreements or other transactions between users.

5.3 User Verification

While we may offer verification services, we do not guarantee the identity, legitimacy, or reliability of users. Users are responsible for conducting their own due diligence.

6. Fees and Payments

6.1 Service Fees

Certain features of the Service may be subject to fees. We will notify you of any applicable fees before you incur them. All fees are non-refundable unless otherwise stated.

6.2 Payment Processing

Payment processing services are provided by third-party payment processors. By using these services, you agree to be bound by their terms and conditions.

7. Intellectual Property Rights

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of FlatShare Portugal and its licensors. The Service is protected by copyright, trademark, and other laws of Portugal and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

9. Disclaimers

9.1 No Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FLATSHARE PORTUGAL NOR ANY PERSON ASSOCIATED WITH FLATSHARE PORTUGAL MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

9.2 No Landlord-Tenant Relationship

We are not a party to any agreements between landlords and tenants. We do not own, operate, manage, or control any accommodations listed on the Platform.

10. Limitation of Liability

IN NO EVENT WILL FLATSHARE PORTUGAL, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless FlatShare Portugal and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us at hello@theflatshare.com.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Lisbon, Portugal.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
